Yes, you're right. Also, there should be other options like... haunt your own yard while tots are coming to your house. And, throw a Halloween party for adults and kids, etc.

does scaring the hell out of little kids while there trying to get some candy fall under the "passing out candy" option?

Well, in addition to passing out Trick or Treat candy and watching horror shows, I might try to get away with my last two orange smoke balls that I have. I do have to be careful, however. The police are everywhere now a days.
